Scope and Contents of the Materials

This collection contains ephemera in support of marriage equality, gathered on the Supreme Court lawn in June of 2015. These artifacts include hand-held flags from the ACLU, a bumper sticker, and signs in support of marriage equality.

Collection Historical Note

During the Obergefell v. Hodges case, groups of same-sex couples sued their relevant state agencies in Ohio, Michigan, Kentucky, and Tenessee to challenge the constituationality of those states' bans on same-sex marriage or refusal to recognize legal same-sex marriages that occurred in jurisdictions that provided for such marriages. The Obergefell v. Hodges case overturned the previous decision of Baker v.s Nelson that state level bans on same-sex marriage were constitutional, holding in a 5-4 decision that the fundamental right to marry is guaranteed to same-sex couples by the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. Previous to the Obergefell decision, thirty-six states, the District of Columbia, and Guam had issued marriage licenses to same-sex couples.
